Agreement to Terms

By downloading, installing, or using LUMI - Simply Brilliant ("the App," "LUMI," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

Description of Service

LUMI - Simply Brilliant is a mobile application designed to help users track anniversaries, events, and special moments with beautiful calendar interfaces, statistics, and customizable themes. The App operates primarily with local data storage on your device.

Eligibility

You must be at least 18 years old to use LUMI. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use LUMI for your personal, non-commercial use. This license does not include the right to:

• Modify, distribute, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Use the App for any commercial purposes
• Remove or alter any proprietary notices or labels

Coin System and Purchases

Coin Purchases

• All purchases are one-time transactions for coins
• We do not offer subscription services
• Coins can be used to unlock premium themes and features
• Coin balances are stored securely and associated with your user account

Payment Terms

• All purchases are processed through secure third-party payment providers
• Prices are displayed in your local currency
• Payment is due immediately upon purchase
• All sales are final unless otherwise required by law

Refunds

Refund policies are governed by the app store through which you made your purchase (Apple App Store or Google Play Store). Please refer to their respective refund policies for more information.

User Conduct

You agree to use LUMI responsibly and in accordance with these Terms. You will not:

• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's functionality
• Use the App to harm, harass, or violate the rights of others
• Attempt to circumvent any security measures

Data and Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. Key points include:

• Most of your data is stored locally on your device
• We only collect minimal information (User ID and coin balance)
• Your personal events and anniversaries remain private
• We do not share your personal information with third parties

Intellectual Property

LUMI and all its content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws. You acknowledge that:

• We retain all rights to the App and its content
• You do not acquire any ownership rights through your use
• All trademarks and service marks are our property
• User-generated content remains your property but you grant us necessary licenses for app functionality

App Updates and Changes

We may update LUMI from time to time to improve functionality, add features, or address security issues. You agree that:

• Updates may be automatically downloaded and installed
• We may modify or discontinue features at our discretion
• Continued use after updates constitutes acceptance of changes

Disclaimers

LUMI is provided "as is" and "as available" without warranties of any kind. We disclaim all warranties, express or implied, including but not limited to:

• Merchantability and fitness for a particular purpose
• Non-infringement of third-party rights
• Uninterrupted or error-free operation
• Accuracy or reliability of information

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or profits, arising from your use of LUMI.

Termination

These Terms remain in effect until terminated. You may terminate your use of LUMI at any time by deleting the App from your device. We may terminate or suspend your access to LUMI at our discretion if you violate these Terms.

Governing Law

These Terms are governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of LUMI will be resolved through appropriate legal channels.

Changes to Terms

We may modify these Terms at any time. We will notify you of any material changes by posting the updated Terms in the App or on our website. Your continued use of LUMI after such changes constitutes acceptance of the new Terms.
